Job summary

The Department for Work and Pensions (DWP) is responsible for welfare, pensions and child maintenance policy. As the UK’s biggest public service department, it administers a range of working age, pension age, disability and ill health benefits to around 18 million claimants and customers.

The Child Maintenance Service (CMS) is responsible for all aspects of child maintenance in Great Britain. Our role is to promote financial responsibility, and to encourage and support private maintenance arrangements, as well as provide a statutory maintenance service.

CMS Enforcement is a fundamental stage in the Payment Compliant process for securing compliance on our most difficult non-paying cases.  Presenting Officers sit within this process, representing CMS in Court and at Independent Appeal Tribunal Hearings. They liaise with caseworkers regarding hearing outcomes, make court applications, serve legal documents and assist with negotiation of debt recovery in the Court Environment.

Job description

You will present in court hearings for contested Liability Orders and Sanctions.  Sanction hearing will primarily be in person and Liability Order hearings could be by phone, video link or in person.  Additionally, there will often be a requirement to negotiate debt with parents in court, ensuring the best outcome for each case.

It is important to build and maintain relationships with court officials in addition to your colleagues and Case Managers across all regions.

As a member of the Court Presenting Team, you will work closely with operational colleagues and external partners such as Solicitors and Enforcement Agents. You will be trained in preparing, presenting, and completing day to day activities, initially being supported by experienced POs at hearings.  At times you will maximise the use of digital technology to facilitate ‘on line’ attendance at hearings as appropriate.

Travel is an essential part of this role as the post holder will be required to attend various courts and tribunals, with overnight stays as required.  A full driving licence would be beneficial.

Your work will involve several aspects, all subject to changing business priorities. You will undertake a range of duties with the following provided as an example:

  • Fully prepare for each case by reviewing information, preparing necessary court documents, and liaising with CMS Case Workers and Legal Support Team (LST)
  • Book, serve and present cases to Magistrates and County Courts, providing information as required in a professional manner and in line with relevant legislation and procedures
  • Provide a face-to-face facility for clients to ensure parents are informed, can discuss issues, and, where appropriate, negotiate payments. Utilising an assertive approach when required and clarifying legislation to aid the courts
  • Following a hearing, complete clear and concise Outcome Reports
  • Manage relationships with key stakeholders and attend key meetings
  • Work as part of a team ensuring sufficient cover for all cases

Person specification

An ideal candidate will be able to evidence the following Essential Criteria within their personal statement:

  • Strong communication skills, including a proven ability to present information to different audiences using appropriate delivery styles and managing challenging conversations (Lead Criteria)
  • The ability to work on your own initiative to organise case load activities, re-prioritising within short timescales when required, whilst delivering outcomes timeously and accurately
  • The ability to support the wider team, displaying flexibility in order to reach a resolution within deadlines
  • The ability to influence and motivate others to build trust with stakeholders to achieve goals
  • The ability to build, manage and maintain key trusting relationships and credibility with a range of colleagues and stakeholders through effective communication to achieve goals
  • An understanding of Child Maintenance procedures and experience of working in an Enforcement environment or similar

Benefits

Working for DWP will include benefits such as learning and development tailored to your role, an environment with flexible working options, a culture encouraging inclusion and diversity and a Civil Service pension with an average employer contribution of 27% Civil Service pension.
